Rules of use & user liability agreement

SCR 10.412

This document governs the use of the SCR 10.412 Kinetic artefact (“Item”) provided by Scroller EV (“Provider”).

By using, operating, testing, renting, or interacting with the Item, the user (“User”) confirms that they have read, understood, and accepted these Rules of Use in full.

 

1. USER ELIGIBILITY

The Item may only be used by persons who:
Are at least 18 years old

 

  • Are physically and mentally fit to operate a powered vehicle
  • Are not under the influence of alcohol, drugs, or medication affecting motor skills
  • Have received basic instructions from the Provider or authorized personnel

 

2. SAFETY REQUIREMENTS

 

  • Helmet use is mandatory
  • Additional protective equipment is strongly recommended
  • The User must inspect the Item before use and report any visible damage
  • The User must operate the Kinetic artefact responsibly, defensively, and with full awareness of
  • surroundings

 

3. PROHIBITED USE

 

  • The Item must not be used:
  • In traffic where its use is not legally permitted
  • For stunts, racing, jumping, or aggressive riding
  • By more than one person
  • On surfaces clearly unsafe for the Vehicle
  • In violation of local laws or instructions provided by the Provider

 

4. ASSUMPTION OF RISK

The User acknowledges that operating an electric Kinetic artefact involves inherent risks, including but not limited to:

 

  • Loss of balance or control
  • Mechanical failure
  • Collision with objects or persons
  • Injury or death
  • The User voluntarily assumes all risks associated with the use of the Item.

 

5. LIABILITY WAIVER

To the maximum extent permitted by law, the User:

 

  • Releases Scroller EV, its owners, employees, partners, and affiliates from any liability arising
  • from the use of the Item
  • Agrees that Scroller EV is not responsible for injuries, damages, or losses incurred during use
  • Accepts full responsibility for their actions and consequences

 

6. DAMAGES & RESPONSIBILITY

The User is fully responsible for:

  • Any damage caused to the Item
  • Any damage to third parties or property
  • Any legal or financial consequences arising from misuse
  • The Provider reserves the right to claim compensation for damages.

 

7. TERMINATION OF USE

The Provider may terminate use immediately if:

  • The User violates these Rules
  • The User behaves dangerously or irresponsibly
  • Environmental or operational conditions become unsafe

 

8. GOVERNING LAW

This Agreement shall be governed by the laws of the Republic of Croatia / European Union (adjust as needed).
